The battle to ensure reinstatement of Sec. 127 is on again. Efforts to secure an
extension for Internal Revenue Code Section 127, employer provided educational assistance,
continue in the 106th Congress. Senator Daniel Patrick Moynihan (D- NY) and Finance
Chairman William Roth (R-DE) and House Representatives Sander Levin (D- MI) and Clay Shaw
(R-FL) have introduced legislation that would permanently extend Section 127 for both
undergraduate and graduate level educational assistance. The House bill, H.R. 323, would
extend Section 127 for undergraduate level courses beginning after May 31, 2000 (the
current law expiration date) and graduate level educational assistance for courses
beginning after June 30, 1996. The Senate bill, S. 211, would provide a permanent
extension upon enactment for undergraduate level assistance and reinstate the benefit for
graduate level courses beginning after December 31, 1998. APA is a member of a large
coalition that will continue to seek a permanent extension of Section 127 for
undergraduate and graduate level educational assistance.
